1. Agreement to Terms
By accessing or using Ensemble design tools, the Ensemble API, or any other HearthByte services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Services.
2. Description of Services
HearthByte provides:
- Ensemble Browser Tools: Free, client-side design tools for generating color palettes, typography, spacing, and complete design systems.
- Ensemble API: A paid service for programmatic access to design system generation.
3. User Accounts
Free Tools
The browser-based Ensemble tools do not require an account. By using them, you agree to these Terms.
Pro/API Access
API access requires a Pro subscription. You are responsible for maintaining the security of your API keys and for all activity under your account.
4. Acceptable Use
You agree NOT to:
- Use the Services for any illegal purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Services
- Resell or redistribute API access without authorization
- Use automated systems to abuse rate limits
- Reverse engineer the Services
5. Intellectual Property
Your Content
You retain all rights to the design systems, color palettes, and other outputs you generate using our Services. HearthByte claims no ownership over your creations.
Our Content
The Services, including their design, code, documentation, and branding, are owned by HearthByte LLC and protected by copyright and trademark laws.
6. API Terms
If you use the Ensemble API:
- You must include valid authentication on all requests
- You must respect rate limits (requests beyond your tier's allocation will be rejected)
- You may use API output in commercial projects
- You may not claim that outputs were created without AI/automated assistance if asked
7. Payment Terms
Pro subscriptions are billed monthly or annually through Stripe. You may cancel at any time; access continues until the end of your billing period. Refunds are handled on a case-by-case basis.
8. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEARTHBYTE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.
10. Indemnification
You agree to indemnify and hold harmless HearthByte from any claims arising from your use of the Services or violation of these Terms.
11. Changes to Terms
We may update these Terms from time to time. Continued use of the Services after changes constitutes acceptance of the new Terms.
12. Governing Law
These Terms are governed by the laws of the State of Washington, USA, without regard to conflict of law principles.
